Human right

Meaning


To analyze the meaning first we should know the basic means of both words.
‘Humans’ are (ASHRAFUL MAKHLUKAT) they are the complete creature of Allah while ‘Rights’ are something that belongs to every individual, it is given by Allah.
If we combine both words, the meaning comes to know, term “Human Rights” is used to highlight the broad range of rights ranging from the right of existence to the right of independent identity.


Definition

Human rights are the fundamental rights that belong to every person from birth until death, it is protected by legislation.


• It is difficult, to sum up, the meaning of human rights because it is a vast phenomenon.

• Human rights are distributed in every person whether he is (black or white), (rich, or poor), or belongs to any ethnicity, race, religion, gender, and language. These rights are equal for all. All enjoy them with legal restrictions.





History

Cyrus Cylinder Charter 539BC


People believed that the right is originated from the Persia Conquered in the year of 539. Human began to get their Human rights. “Cyrus the Great”, The king of Persia, he was the who declared the first charter of Human Rights is known as The Cyrus Cylinder. In this charter, he authorizes the slavery people for freedom of choice. They have given the fully right to choose their culture and religion according to their choice.


• This charter is rapidly spread in some countries as a natural right.

The Magna Charter (1215)

It was 15 June in 1215 when the Magna charter by the hands of King John under the pressure of Baron because on that time Monarchy system on the peaks where whole state is governed by Kings, and King John was rebellious in nature, all state people were fed up with his behavior therefore in the end they sum up this charter in England under the church or pops which are well known by their religion. In Magna charter they clarify the Rights of re-establishment of principle equally in condition it will be follows in certain restrictions and no one can go beyond the law.


• Petition of Right (1628)

After spreading the Human Right English parliament is developed the human rights as a partition of Rights which held the Charles I as the progress of Civil liberties. It will not acceptable the changing in rights without the presence of parliament. They focus the taxes peace and laws. 




The Constitution of the United States of America (1787) and Bill of Rights (1791)


The Constitution of the United States of America is written in 1787. They formulate the American law in the US federal system. It is all about the basic rights of citizens while The Bill of Rights took its place in 15 Dec 1791 that also focuses the rights of society and freedoms but in the presence of limited federal government of US.

The UN Charter (1945)

The United Nations charter was purposed late the World War II. The purpose of this charter to establish the UN organization and the member of their organization. This charter was signed on 26 June 1945 in San-Francisco by arranged the conference with their neighbor states. In UN charter They formulated the 111 articles where they fully concern on equality and unity. To make the strong relation among neighbor countries.

The UDHR Charter (1948)
The Universal rights are spread in worldwide. These rights are equally distributed among all the humans. These rights are equally applicable to all humans irrespective of gender, race, color, culture, and economic status. According to UDHR, Article no-1, there is clearly mentioned that ‘Everyone is born free and equal.

Universal declaration of human right

Introduction

After world war II ceased the United Nation persuade the government that we make the Charter of human, to prevent war and conflict. On December 10, 1948, the United Nation general assembly proclaimed the Universal Declaration of Human Rights. The declaration was spread all over the world it is considered as the 1st Charter. The charter emphasis on the point that every individual is equal no matter where he/she belongs matter is that they are a human being. According to this charter, power is divided equally, no one is inferior, or no one is superior. UD have the power of ideas that changes the world.


Following are the Law & Legal Rights


Article No -1


1. Human Are Born Free and Equal

Human are born free and equal and deserves to enjoy their rights with dignity. They have conscience behavior with each other, and
they are entitled in the spirit of brotherhood toward one and other.



Article No - 2

2. Do not Discriminate

Do not create the concept of discrimination among Human beings
because humans are born the same eternally just there is the differences of organs in genders. Although people are rolling in the concept of racism in the reference of (Color, language, Idealism, Religion, and Sex). Nevertheless, article no-2 cracks the discriminations and teach us the equality and humanity. Human rights play a vital role in demolishing the concept of discrimination from society, which helps in protecting the people from injustice, oppression, repression, and mistreatment. It also enables people to stand up against any distinction or abuse. It prevents religious violence, respects the importance of spiritual beliefs, and allows you to practice them peacefully.

3. The Rights of Life

Everyone has the right to enjoy their life according to their choice. In this article liberty and security is mandatory for every human.
No one has right to pull anyone’s leg or mock someone’s emotions.


Article No - 4

4. No Slavery

Whenever the word ‘Slavery’ comes in our mind, it creates an
image and situation, and ones can feel sympathy and pain for them and think that how they were treated by their owners while remembering the prior period of the British monarchy when they treat Muslims and Hindus as a helpless person who could not able to do anything without their orders. Eventually, after colonialization Muslims and Hindus became independent. This period illustrates that how slaves worked under their owners. The Article No-4 is totally opposed to the slaved authority. No one can use someone’s life as a football whenever you want, you play with their emotion by kicking them unless they become useless in work.

5. NO TORTURE

No one shall be impersonated without any reason.  Subjectification to torture with cruel actions is prohibited. Let them live naturally instead of blackmailing it will be counted as punishment.


Article No - 6

6. YOU HAVE A RIGHT NO MATTER WHERE YOU GO

Before the law, each person is considered as an innocent person. No matter where they go in order to enjoy their lives but in case if they go beyond the law and cross its certain limits then it will be punished.



Article No - 7

7.  Everyone Is Equal Before the Law

All are equal unless it goes beyond the law. Never create discrimination in the protection of law. Legislative should
coinsider all humans as same and treat them equally whether they are belongs to poor families or prestigious class.


Article No – 8

8. Humans are Protect by Law

Every one has right to speak up against violations and try those which demolished the violation in Human Society. The society which are based on equality and built from it instantly ‘Peace cannot be exist until the observation and the presence of justice’.

9.  No Unfair

Unfair and subjective will not be worked on human it will be counted as opposition of Human Rights and No one can break the certain human rights either governor or judge whoever if tried then they will also be punished by supreme court.



Article No – 10

10. Right of Trial

Everyone has the right to speak for their rights. Each Human gives a fully fair and before judging or targeting someone first listen to them. The Article 10 is described that no one fleck any person
without knowing their background.



Article No – 11

11.  We Are Always Innocent till Proven Guilty

No one make anyone as a criminal until having the evidence in hands. Make someone feels guilty in public place is prohibited. Public trial will be crime therefore if he/she has done any crime so let them do you just have to bring the prove against them in front of legislation, criminal will be charged by their own actions.

12.  The Right of Privacy

Privacy of individual is the mean of protection someone’s reputation. Each person wants security in their life. No one can
interference in their privacy. Everyone has their own life to live in certain means we are not owner to ask from them that what are doing. Expose someone’s privacy is accountable as a personal attack and it will lead towards the punishment.

13.  Freedom to Move


The Article no 13 refers to the freedom of moves. Give freedom like a bird that fly everywhere either its own state or another one nevertheless there will be a certain limitations that are undertaken upon the law.

14.  The Right of Seek & Safe Place to Live

Every individual has the right to live in a peace full place where they enjoy their lives. According to recent survey of scholars 19 million kids flee from their homes in order to get freedom constantly they always crush by the hands of monarchy like an ant crusher under the foot of people. The Monarchy should give shelter to people where a single person lives their life peacefully.

15.  The Right of Nationality


Every human has the right to consider himself with his country's nationality and proudly say I belong to this country as if you belong to Pakistan then wherever you stand you have the freedom to explore your nationality. No one shall be tortured on the basis of their nationality.





Article No – 16

16.  Marriage & Family

When men and women become adults, they have the full right to choose their partner by their own choice without thinking abo
ut race, nationality, status, or religion. The matter is love and better understanding if both things are having in them then they can start their happy healthy life and make a new family.




Article No – 17

17.  The Right of Ownership

Everyone has the right of private ownership no one has right to hold anyone’s property.



Article No – 18

18.  Freedom of thought

Every human has the right of thought, each person wants the open house where they can share their thought and ideas in all factors either it belongs to the institution or any office.



Article No – 20

20.  The Right of Public Assembly

Every human being has the right to stand and raise their voice against the violence. People have the right to protest against the prestigious class. If any governor or officer follows the negative path so people can freely take action and opposed towards their negative actions.



Article No – 21

21.  The Right of Democracy

Everyone has the right to vote and join politics directly and participate freely. Democracy has more power more than governors because democracy leads to choosing the governor. In each sector democracy matters a lot as usual people listen those who has democratic policy.




Article No – 22

22.  Social Security

A number of societies has the right to feel secure in their country. Whenever he or she goes anywhere in the core of society they feel fearless, no one can attack them, and they go back to their home on two feet.

23. Workers' Right

Workers are paid equally according to their works, do not discriminate any labor in behavior and salary. Every worker has the right to get favor by their owner for families. To protect the right
individual shall join any trade unions for backup.


Article No – 24

24.  The Right of Play 

There is no limitation in any sports. Everyone has the right to enjoy their life in holidays, so we shall participate in each sports and activities from that one mind become fresh and active. 


Article No – 25
25.  Rights of Food & Shelters

Every individual should take care of his/her neighbors if there is any person needs to help you can help them without asking. The rights of food and shelter for all means governors should concern on poor persons same as they concern on wealthy people. Monarchy shall be equally facilitated to each human. The main needs which every individual want is.

26. The Right of Education
Education wants to be free because everyone wants to educate their child. Education should be provided equally in all sector whether it is private or government. No one can pressurize to their child in the name of their future however in case child are not following the right path then Encourage them by giving the best examples of life and manipulate them according to their best future.

27. Copyright is claimed 

To copying other’s works is prohibited, it will consider as a crime. Everyone has equal rights to participate in the cultural life of community, to enjoy art and share unique adventures.

28. Fair & Free World

Everyone has the right to enjoy their life in any corner of the world. No one can restrict them as human are born free and equal, so they have fully relived.

29. Protect the Rights of Others

Every human has the duty to protect other rights and create the chain of that so, no one can harm any person. If you want to build your country so table for your rights and society members spread the brotherhood and determined the nature in order to create good understanding with each other hence you achieve the peaks.



Article No – 30

30. No One Take Away the Human Rights

In the last article, there is mentioned that no one can be able to take away the human rights from us because United Nations takes the responsibility to safe your rights. The UDHR is not for the state, it is framed in the worldwide level so each human can follow these 30 articles.
